Acceptance of Terms

Hutfloor App provides a platform for users to buy and sell fashion items. By accessing or using the App, you agree to be bound by the Terms of this Agreement. If you do not agree to the Terms, please do not use the App. The Company reserves the right, in its sole discretion, to modify the Terms at any time. Your continued use of the App following the posting of any changes to the Terms constitutes acceptance of those changes.

Eligibility

To use the App, you must be at least 18 years of age and have the capacity to enter into a binding agreement. By using the App, you represent and warrant that you meet these eligibility requirements and that you agree to abide by all of the terms and conditions of this Agreement.

App Use

To use the App, you must create an account. When creating an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password. You may not use someone else's account without their permission. If you suspect that someone has access to your account without your authorization, you must immediately notify the Company.

User Content

The App allows you to upload and post content, including, but not limited to, images, descriptions, and pricing information for items for sale (collectively, "User Content"). You retain all rights in your User Content and are solely responsible for it. By uploading or posting User Content to the App, you grant the Company a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, and display your User Content in connection with the App. You represent and warrant that you have all rights to grant such a license and that the User Content does not infringe any third-party rights.

Prohibited Items

You may not list or sell any items that are prohibited by law or the terms of this Agreement. The Company reserves the right to remove any listings that it determines, in its sole discretion, to be in violation of the terms of this Agreement or applicable law. Payments The App allows for the sale and purchase of items through the platform. You agree to pay the price listed for any item you purchase through the App. The Company may use third-party payment processors to process payments. By using the App, you agree to the terms and conditions of the applicable payment processor and to pay any fees or charges associated with your use of the payment processor.

Disclaimer of Warranties

The App and its services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not represent or warrant that the App will be uninterrupted or error-free, and the Company is not responsible for any delays, interruptions, errors, or losses. The Company does not endorse any User Content or any opinion, recommendation, or advice expressed therein, and the Company expressly disclaims any and all liability in connection with User Content.

Limitation of Liability

The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the App.

Termination

he Company may, in its sole discretion, at any time terminate or suspend all or a portion of the App, or your use of all or a portion of the App, with or without notice and with or without cause.

Governing Law

This Agreement shall be governed by the laws of the jurisdiction in which the Company is headquartered, without giving effect to its conflict of law provisions.

Dispute Resolution

Any dispute arising from or related to this Agreement or your use of the App shall be resolved through binding arbitration. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association.

Entire Agreement

This Agreement constitutes the entire agreement between you and the Company and governs your use of the App, superseding any prior agreements between you and the Company with respect to the App. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
